By downloading, installing, or using the PacePal mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PacePal is an intelligent running coach application that provides:

  • Real-time AI-powered coaching with audio guidance during runs
  • Comprehensive performance tracking: distance, pace, heart rate, and cadence
  • Post-run AI-generated analysis with personalized improvement recommendations
  • Seamless integration with Apple Health and Google Fit
  • Bilingual support in English and Chinese
  • Two distinct coaching personalities: Luna (supportive) and Lucas (motivating)

3. User Eligibility

You must be at least 13 years old to use PacePal. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Health and Safety Disclaimer

IMPORTANT: PacePal is not a medical device and should not replace professional medical advice, diagnosis, or treatment.

  • Consult a healthcare provider before starting any new exercise program
  • Coaching guidance is for motivational and informational purposes only
  • Health metrics are estimates and may not be medically accurate
  • Stop exercising immediately if you experience pain, dizziness, or discomfort
  • Stay aware of your surroundings while running and using the App
  • Always follow local traffic laws and safety regulations

YOU USE THE APP AT YOUR OWN RISK. WE ARE NOT LIABLE FOR ANY INJURIES OR HEALTH ISSUES THAT MAY OCCUR FROM USING THE APP.

5. User Responsibilities

You agree to:

  • Provide accurate information when using the App
  • Maintain the confidentiality of your account credentials
  • Use the App in accordance with all applicable laws and regulations
  • Not attempt to hack, reverse engineer, or tamper with the App
  • Not use the App for any illegal or unauthorized purpose
  • Be responsible for your own safety while running

6. Permissions and Access

The App requires certain permissions to function properly:

  • Location Services: To track your running distance and pace
  • Health Data: To access heart rate and step count (with your consent)
  • Audio/Microphone: To provide coaching audio and manage audio ducking
  • Background Activity: To continue coaching when the App is in the background

You can revoke these permissions at any time through your device settings, though this may limit App functionality.

7. AI-Generated Content

Coaching advice and feedback provided by PacePal is AI-generated and may not always be accurate or appropriate for your individual situation. Treat this coaching as general guidance rather than personalized professional training advice.

8. Intellectual Property

All content, features, and functionality of the App—including text, graphics, logos, audio clips, coach characters (Luna and Lucas), and software—are owned by PacePal and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Third-Party Services

The App integrates with third-party services including Apple Health, Google Fit, OpenAI, and text-to-speech providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of third-party services.

10. Subscription and Payments

If the App offers premium features or subscriptions:

  • Subscriptions automatically renew unless canceled
  • You can cancel at any time through your App Store or Google Play account
  • Refunds are subject to Apple App Store and Google Play Store policies
  • Prices may change with notice

11. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INJURIES, ACCIDENTS, OR DAMAGES ARISING FROM USE OF THE APP
  • WE ARE NOT LIABLE FOR INACCURATE DATA, LOSS OF DATA, OR TECHNICAL ISSUES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS
  • WE ARE NOT LIABLE FOR THIRD-PARTY SERVICES OR CONTENT

13. Indemnification

You agree to indemnify and hold harmless PacePal and its affiliates from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or violation of any rights of another party.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may also terminate your use of the App by deleting it from your device.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law provisions.

18. Severability
